Unfortunately, about 60% of claims are initially denied. If you or a loved one applied and have had disability benefits denied, you have only 60 days from the date on the denial letter to file your request for an appeal.

My disability claim was denied. What can I do now?
First, you should know it is not the end of the road – as many as 60% of initial claims are denied. You do, however, have to act immediately: you have only 60 days from the date on your denial letter to file a request for an appeal.

Do I need a Social Security Disability lawyer?
No, you do not need an attorney to represent you, but even the SSA admits that those who have attorneys have a better chance of a successful result. The Social Security Disability team at Plachta, Murphy & Associates is committed to helping you receive the benefits to which you are entitled. Miles J. Murphy, III and Richard J. Cross not only know what information the SSA needs, they also know what the SSA is really looking for.

How much does a Social Security Disability attorney cost?
Usually (though not always) attorney’s fees are on a contingency basis. If your claim is successful, your lawyer receives a percentage of back benefits (not to exceed a total of $5,300) and you receive the rest. If you claim is denied, the attorney receives no fee at all.

What information do I need to bring to my appointment?
You should bring the names and contact information for any doctors or medical personnel (such as ambulance companies) you’ve seen, as well as the names of any medications you are on. It is also helpful if you bring the estimated earnings statement the SSA sends you every year before your birthday.

What if my appeal is denied?
There are other appeals we can pursue, so even a second denial doesn’t have to be the end of the road.

My appeal was denied a while ago, but my condition has worsened. Can I apply again?
Yes, you can. There is no limit for how many times you can apply for Social Security Disability Benefits.
